Our Section 405 Response
Given Mr. Zapata's own suspension, we have taken it upon ourselves to provide a measured response to how this matter should be handled by a competent, fair and ethical city Manager.

We have made this available to Mayor Cutter, Current July 2018 Members of City Council as well as selected top Administrators in the City of San Leandro.
The questions for them are the following:
1. Did Mr. Zapata and the Former Community Directory, Cynthia Battenberg act in a manner consistent with City of San Leandro values
2. How will the Municipal Code be changed so that Code of Conduct violations such as these merit disciplinary action?

Current Complaint to Mayor and Council
We filed our latest complaint on December 8, 2018 after City Clerk Greenwood and City Manager Zapata refused to take in the evidence we provided in our October complaint against Director Battenberg. We hope the Mayor and City Council persuade Mr. Zapata to appoint an Independent Professional Investigator to look into the extensive list of violations we have presented.

Manager Zapata forwarded our letter to Director Battenberg and suggested that we have a meeting to discuss our concerns. He refused to move forward with an Investigation - the need for which is our concern. We wrote to him privately to ask him what the agenda and desired outcome of his suggested meeting would be and we have yet to hear back.
